SEASONAL RENTAL CONTRACT

 

BETWEEN THE UNDERSIGNED,

hereinafter referred to as "the Lessor"

The person making the reservation and who has sent their contact details via the online booking site,

hereinafter referred to as "The Tenant"

ON THE OTHER HAND

 

It has been agreed between the parties that the Lessor shall rent to the Tenant the accommodation as described below under the following conditions:

 

1. PURPOSE OF THE RENTAL AGREEMENT

 

The parties declare that this lease is not for leased premises for use as a main dwelling or a mixed-use business and a main dwelling.

Consequently, they agree that their respective rights and obligations will be governed by the stipulations of this contract, by the decree of December 28, 1976 amended and failing this by the provisions of the civil code.

The premises covered by this contract are rented furnished on a seasonal basis.

 

 

2. DESCRIPTION OF HOUSING

 

Address of the accommodation: 20 Allée de la Meilleraie

85340 OLONNE ON THE SEA

 

The accommodation corresponds to that presented on the sites: www.villa-sablesdolonne.com and www.homelidays.fr/hebergement/p1495225 .

A precise description of the dwelling is attached in Appendix A.

 

                                                    

3. DURATION OF SEASONAL RENTAL

 

The Lessor shall rent to the Tenant accommodation for the number of nights and for the dates specified on the booking site. In the general case, arrivals are at 17:00 and departure at 11:00. Exceptions : for a Weekend, late check out is at 16:30 on Sunday ; Sunday, arrival is from 19:30

 

The Tenant expressly agrees to have fully vacated the accommodation no later than the date and time indicated, and to return to the Lessor the keys according to the agreement agreed between the parties.

 

 

4. OCCUPANTS OF SEASONAL RENTAL

 

The Lessor shall rent the accommodation to the Tenant for the maximum number of adults and children that the Tenant has specified on the booking site.

 

 

5. RENTAL PRICES AND EXPENSES

 

The rent fixed on the booking site is for the full duration of the rental described in paragraph 3.

 

The rent includes, for the duration of the lease, the payment of the rental charges and available supplies recalled hereafter:

- city water, electricity, heating, Internet access and television;

- Loan of 20 adult bicycles and children's bicycles;

- End of the stay cleaning ; "Beds made before arrival" service, bed linen and towels;

- Care kit, kitchen kit, smart basket ... detailed on page 7

- 2 umbrella beds and 2 high chairs

 

Access to the heated pool at 28 ° and the hot tub heated to 36 ° are optional.

 

 

6. BOOKING DEPOSIT

 

In order to proceed to the booking of the accommodation, the Tenant has accepted the present contract when booking online, and paid a deposit corresponding in the general case to 50% of the total rental price indicated in paragraph 5.

This payment is made by an online payment on the booking site (It can also be made by bank transfer, however the reservation will be effective upon receipt of payment).

 

 

7. BALANCE PAYMENT

 

The balance of the rent indicated in paragraph 5, in the general case 50% after deduction of the amount of the deposit, will be paid by the Tenant at the latest upon entry into the accommodation. Payment of the balance by check is no longer accepted: the Tenant will make the payment in cash or / and by bank transfer. In the case of a bank transfer, the tenant will take care to realize it sufficiently early so that it is perceived before the entry in the rental.
Payment by credit card is possible with 2% fee.
The Lessor will give the Tenant a receipt for any payment made.FDS  

 

 

8. GUARANTEE DEPOSIT

 

At the latest when entering the premises, the Tenant will give the Landlord an amount of € 1000 as a security deposit to cover (totally or partially) the losses and / or damages and / or deterioration of housing and furniture and objects lining the accommodation caused by the Tenant.

 

The Tenant will make the deposit in cash or by bank transfer. The check is also tolerated. In the case of a bank transfer, the tenant will take care to realize it sufficiently early so that it is perceived before the entry in the housing.

 

In the general case the deposit will be returned to the Tenant within 3 days after departure if there is no loss and / or damage and / or degradation of housing and furniture and objects lining.

Otherwise, the deposit will be returned to the Tenant within a maximum period of one month after departure (maximum period if an estimate must be established), minus the amounts covering the losses and / or damage and / or damage to the accommodation and furniture and objects garnishing it.

If these amounts are greater than the deposit, the tenant remains liable for additional amounts to the amount of the deposit.

 

 

9. ASSIGNMENT AND SUB-LEASE

 

This lease is concluded intuitu personae for the sole tenant identified at the head of the contract.

 

Any assignment of this lease, any sub-lease total or partial, any provision even free, are strictly prohibited. The Tenant will not be able to leave the layout of the premises, even free of charge and / or by loan, to a person outside his home.

 

 

10. STATE OF PLACES AND INVENTORIES

 

An inventory of fixtures and an inventory of the furniture made available to the Tenant are given to the Tenant upon entering the accommodation.

 

If the inventory and the inventory are not established and signed by the Lessor, or his representative, and the Tenant simultaneously (inventory and contradictory inventories), the inventory and inventory made by the Lessor only and given to the Tenant upon entering the accommodation will be contestable by the Tenant within 24 hours of entry into the accommodation. In the absence of dispute by the Tenant within this period of 24 hours, the inventory and inventory made by the Lessor and communicated to the Tenant upon his entry into the premises will be deemed accepted without reservation by the Tenant.

 

An inventory and inventory will be established by the Parties at the end of the lease, each retaining a signed copy.

 

In the absence of inventory and / or inventory at the end of the lease or if the Tenant establishes only the inventory and / or the inventory at the end of the lease, the absence of dispute by the Lessor within 72 hours after the end of the rental will be worth restitution places in good condition and / or complete inventory.

 

 

11. DECLARATION OF THE LESSOR

 

The Lessor declares to be the owner of the housing and to have the free disposal and the full enjoyment during the period defined in paragraph 3. The Lessor will justify it by the production of a receipt EDF, a notice of Property Tax or any other document official on request.

 

 

12. OBLIGATIONS OF THE TENANT

 

The Tenant will use peacefully the rented accommodation and furniture and equipment according to the destination that has been given them by the lease and liable for damage and losses that may occur during the contract period in the premises under its exclusive use.

The Lessee will not be able to exercise any recourse against the Lessor in the event of theft and depredations in the rented premises. The tenant will ensure the closure of all access to the property.

 

The Tenant must immediately inform the Landlord as soon as he knows that a major equipment is damaged or not functional (television, bike, swimming pool, jacuzzi ...).

The Tenant will maintain the rented accommodation and will make it in a good state of cleanliness and rental repairs at the end of the contract. If items are damaged, the Lessor may claim their replacement value.

A normal end-of-stay cleaning will be done by the Lessor. However, if additional cleaning or restoration work is required, the Lessor may claim their reimbursement.

 

In accordance with the regulations, it is strictly forbidden to park on the pavement or the sidewalks (prohibition sign at the entrance to the subdivision, obstructing access to firefighters invoked by the Municipality): private parking and 10aine car parks available in the immediate vicinity must be used for the tenant's parking needs.

 

In accordance with the safety and prefectural regulations, it is strictly forbidden to fire fireworks in the garden, to sound the garden, or to enter sound or food-truck type vehicles or other, to organize events open to the public or invite strangers into the property.

The Tenant will not exceed the maximum number of people allowed in the premises and defined in Article 4 of the contract. Fire safety regulations stipulate that the number of people sleeping in a furnished apartment does not exceed 15 persons. It should not exceed this number of beds in the main building.

 

The Tenant agrees to respect the neighborhood: the Tenant must avoid any noise likely to annoy the neighbors day and night.

For example, during the day it is forbidden to systematically shout between each point played at ping-pong, bowling, swimming pool or other: the recurrence of cries is a diurnal noise banned by law and sanctioned as the night fuss . From 22h, shouts and songs are strictly forbidden in the garden and around the property.

The housing is very well isolated (RT2012) and it is possible to make noise and music inside the housing. However, the Tenant must first ensure that all the windows (and especially the tilt and turn of the WC and SDB are perfectly closed.) The smokers will have to go out in the garden by a SAS of doors rather than by the bay windows so that the music do not wake the neighborhood when they come out, they will have to speak quietly at night in the garden.

It is forbidden to enter and ring on nearby private properties to collect balloons or other: repeated at each stay, it would be disturbing for neighbors. It is also forbidden to disturb the neighborhood to give them an anniversary, a bachelor party or other party (as there is always something to celebrate during each stay, all year) or ask them to intervene. There is too much noise: they do not need to frame your party which must respect the laws, the contract and the recommendations of the Lessor.

 

The Tenant may not oppose the visit of the premises if the Lessor or his agent makes the request.

In the rental, the tenant must be reachable by phone if the Landlord must indicate a problem (on the phone of the Tenant or if necessary on the dedicated phone in the living room). If it does not succeed, the Lessor will stop the music, TV or internet remotely so that the tenant can hear the phone ringing and be informed of the problem as soon as possible.

 

Failure to comply with these contractual obligations, laws or regulations, as determined by the Police or the Lessor, may lead, depending on the need, to the interruption of the internet and electricity, the rupture of the immediate rental and without compensation (eviction ), tickets and legal proceedings.

 

 

13. BEDROOM AMENITIES

 

The Tenant has access to the number of rooms agreed according to the number of occupants (2 occupants per room in the general case).

 

The bed linen is provided. Most rooms have a double bed, however on request to make the help of the table below, some rooms can be arranged with 2 single beds.

 

Bedroom 1: 1 double bed

Bedroom 2: 1 double bed or 2 single beds

Bedroom 3: 1 double bed or 2 single beds

Bedroom 4: 1 double bed or 2 single beds

Bedroom 5: 1 double bed

Bedroom 6: 1 double bed or 2 single beds

Bedroom 7: 1 double bed

Room 8 extra (without window): 2 single beds

2 beds and 2 high chairs are available.

 

 

14. CANCELLATION AND PREMATURE DEPARTURE

 

The owner has a period of 24 hours for the cancellation without costs or compensation of an online reservation in the case of an error in setting the rate.

​

Any cancellation must be notified to the other party by registered letter, or by any other means leaving proof of the correct reception and reading of this cancellation.

 

The Tenant may, with the agreement of the Lessor, substitute any person who agrees to contract under the same conditions. In this case, the deposit is deemed paid by the Tenant substituted.

 

In other cases, it is agreed that the party who cancels will pay to the other as compensation:

- 20% of the amount of the rent of the canceled period in case of cancellation more than 3 months before the beginning of the stay,

- The full rent of the canceled period in case of cancellation less than 3 months before the beginning of the stay.

 

If the cancellation is made by the Lessor, the lessor pays the deposit paid and pays the compensation. If the cancellation is done by the Tenant, the compensation is retained on the deposit. The compensation is however not due in case of force majeure.

 

The premature departure of the Tenant does not entail any refund, even partial, of the price of the stay.

 

 

15. TERMINATION OF FULL RIGHT

 

In case of breach by the Tenant to one of the contractual obligations, this lease will be terminated automatically. This termination will take effect after a simple written summons remained unsuccessful.

 

 

16. ELECTION OF DOMICILE

 

For the execution hereof, the Lessor and the Tenant shall elect domicile in their respective homes. However, in case of dispute, the court of domicile of the Lessor shall have sole jurisdiction. This contract and its consequences are subject to French law.

APPENDIX A - DESCRIPTION OF HOUSING

Housing parts:

cathedral living room, open kitchen, a bathroom with bath and shower, a shower room, 2 toilets including 1 in the shower room, 5 bedrooms, a laundry room, a bicycle garage.

For reservations of more than 10 people: a 6th bedroom and an additional shower room.

For reservations of more than 12 people: a 7th bedroom and an additional toilet.

For reservations of more than 14 people: an 8th extra room.

 

Swimming pool: 32 m² (8m x 4m), not overlooked, Spa. Garden shower.

 

Garden: South exposure, large terrace; garden table with 20 chairs, barbecue, parasol, deckchairs. 3 private parking spaces adjoining the villa. Ping-pong table and various games (football goal, balloons, badminton rackets ...).

Parking: 2 private parking spaces adjoining the villa.

For bookings of more than 10 people: a 3rd private parking space adjoining the villa.

Other free parking spaces are available on the public domain in the immediate vicinity of the villa.

 

Lounge-dining room: south facing, bay window with access to the garden. Table with 20 chairs. Living room with 3 leather sofas, 2 armchairs and coffee table, 3D giant screen, home theater, 3D Blu-ray player with various movies and 3D glasses, WII U game console with 4 controllers and 4 wheels (Mario-Kart 8 game).

Fitted kitchen: south facing, bay window with access to the garden. Dishwasher, double sink, cupboards, two large fridge-freezers, induction hob, oven, extractor fan, microwave, toaster, Nespresso machine, coffee maker, kettle, crockery and cooking utensils.

Bathrooms and shower: sink, cupboard, electric towel rail, hair dryer.

Bedrooms: sliding closet with shelves and wardrobe. Bed linen is provided (sheets, duvets and covers, pillowcases). LCD TVs in rooms 1, 2 and 7.

Laundry room: 3 washing machines, tumble dryer, iron and ironing board.
